Article 1 — Scope

These Terms of Service ("Terms") govern the contractual relationship between TAC Kendal (hereinafter "the Seller"), operating the website boutique-avengers.fr, and any individual acting as a consumer (hereinafter "the Customer") making a purchase on the Site. Placing an order on the Site implies unreserved acceptance of these Terms.

Article 2 — Products

The products offered are items inspired by the superhero universe, not affiliated with Marvel, Disney, or the official rights holders (see the non-affiliation clause in the Legal Notice). They are sold subject to availability from the Seller and/or its partner suppliers, who handle all or part of the manufacturing and shipping of products to the Customer. The Seller remains solely responsible to the Customer for the proper fulfillment of the order, in accordance with Article L.221-15 of the French Consumer Code.

Article 3 — Prices

Prices are shown in euros (€), all taxes included. The Seller reserves the right to change its prices at any time; the applicable price is the one in effect at the time the order is confirmed. For deliveries outside the European Union, customs duties or local taxes may remain the Customer's responsibility.

Article 4 — Order

The Customer confirms their order after reviewing the summary (products, price, delivery costs, address). The order becomes final once payment is confirmed, with a confirmation email sent to the Customer.

Article 5 — Payment

Payment is made online at the time of ordering, using the payment methods offered on the Site (Shopify Payments and/or other available methods).

Article 6 — Delivery

The estimated delivery time is 7 to 14 business days, for France, the European Union, and international destinations alike, subject to the details set out in the Shipping Policy.

Article 7 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 full days from receipt of the product to exercise their right of withdrawal, without justification or penalty.

In accordance with the regulations in effect since June 19, 2026, the Customer may exercise this right via the online withdrawal feature available in their order tracking area, or via the link provided in the confirmation email. A time-stamped acknowledgment of receipt is sent to the Customer without delay on a durable medium (email).

If no dedicated feature is available, the Customer may notify their decision by email to shop@boutique-avengers.fr.

In accordance with Article L.221-28 of the French Consumer Code, the following are excluded from the right of withdrawal: personalized products, products unsealed after delivery for hygiene reasons, and goods likely to deteriorate rapidly.

Article 8 — Legal guarantees

All products automatically benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). Contact: shop@boutique-avengers.fr.

Article 9 — Liability

The Seller cannot be held liable for damages resulting from improper use of the product, force majeure, or the actions of a third party (delays attributable to carriers or suppliers).

Article 10 — Personal data

The processing of the Customer's personal data is described in the Privacy Policy.

Article 11 — Mediation and disputes

In the event of a dispute, the Customer is invited to first contact the Seller at shop@boutique-avengers.fr.

These Terms are governed by French law, subject to the mandatory consumer protection rules applicable in their country of residence for Customers within the European Union.
